Going to Your Disability Hearing Without an Attorney?

You have a disability claim and the next step is a hearing in front of a judge. For whatever reason, you don’t have a lawyer already.
If you rely on Social Security to explain what you have to prove you are likely operating under an incorrect definition of disability. This is literally what I copied from SSA’s web site today:
WHAT DOES “DISABLED” MEAN FOR AN ADULT?
If you are age 18 or older we may consider you “disabled” if you have a medically determinable physical or mental impairment (including an emotional or learning problem) which:
results in the inability to do any substantial gainful activity; and
can be expected to result in death; or
has lasted or can be expected to last for a continuous period of not less than 12 months.”
I think it is kind of ugly that SSA leads with a statement that is inaccurate for a large number of disability applicants; that they must be unable to do any substantial gainful activity with the statement that the problems are disabling if they are expected to kill you. The truth is your problem needs to last 12 months or more, unless it is expected to kill you faster.
